Welcome to Wordmate.ai ("the Service"), operated by Makiapps SL, a limited company registered in Spain (CIF B21783261), with its registered office at Calle Manuel Tovar 33, 3º planta, 28034 Madrid, Spain ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Overview

Wordmate.ai is a vocabulary-learning platform that uses artificial intelligence to enhance reading and language acquisition through browser extensions, web and mobile apps, and related tools.

These Terms govern your access to and use of the Service, including any paid or free features, websites, and applications we operate.

2. Eligibility and Accounts

• You must be at least 16 years old (or the minimum legal age in your jurisdiction) to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• We may suspend or terminate accounts that violate these Terms or for any misuse of the Service.

3. Subscriptions, Trials, and Payments

• Wordmate.ai offers both free and paid subscription plans, managed through Stripe.
• Paid plans renew automatically on a monthly basis unless canceled before the next billing cycle.
• A 7-day free trial may be provided; we reserve the right to modify or withdraw trials at any time.
• Prices and features may change. We may increase or decrease pricing, add or remove plans, or modify usage limits at our sole discretion.
• We are not required to notify users of general plan changes unless such changes directly affect an active paid subscription.
• Taxes (including VAT) will be added where applicable.
• Except where required by law, payments are non-refundable.

4. Use of the Service

You agree not to:

• Use the Service for unlawful, harmful, or abusive purposes.
• Attempt to reverse-engineer, copy, or resell the Service.
• Interfere with or disrupt our systems or networks.
• Misrepresent your identity or affiliation.

We reserve the right to suspend or terminate any account violating these conditions.

5. Artificial Intelligence Disclaimer

Wordmate.ai uses AI models and third-party APIs (e.g., OpenAI, Anthropic, and others) to generate or modify content. AI-generated or modified content may contain errors, inaccuracies, or unintended changes in meaning.

You acknowledge and agree that:

• The Service is provided "as is" and "as available."
• We make no guarantees regarding accuracy, completeness, or suitability for any purpose.
• You use AI-generated content entirely at your own risk.
• Makiapps SL, its affiliates, and partners shall not be liable for any loss, damage, or consequence arising from your reliance on or use of AI outputs.

6. Data and Content

• You retain ownership of your own content, including text and materials you upload or input.
• By using the Service, you grant us a limited, non-exclusive, worldwide license to process that content as needed to provide and improve the Service.
• We may store anonymized snippets or examples of user text (such as dictionary definitions or word insertion contexts) to evaluate or improve system performance.
• We do not use your content to train proprietary AI models, but we may share it with third-party processors strictly for operational purposes under GDPR-compliant agreements.

7. Intellectual Property

All intellectual property related to Wordmate.ai, including trademarks, software, design, and text, is owned by Makiapps SL or its licensors. No license or right is granted to users except as expressly permitted under these Terms.

8. Changes to the Service

We may at any time:

• Add, remove, or change features;
• Modify usage thresholds, limits, or pricing;
• Discontinue parts of the Service.

We will provide reasonable notice of significant changes that materially affect paid subscribers. Continued use after such changes constitutes acceptance of the updated Terms.

9. Termination

You may cancel your subscription or delete your account at any time. We may suspend or terminate your account immediately if you breach these Terms or misuse the Service.

Upon termination, your right to use the Service ceases, and we may delete your data in accordance with our Privacy Policy.

10. Disclaimers and Limitation of Liability

The Service is provided "as is," without warranty of any kind. We disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, or reliability.

To the maximum extent permitted by law:

• Makiapps SL and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages;
• Our total liability shall not exceed the amount you paid in the preceding 12 months.

Nothing in these Terms excludes liability that cannot legally be excluded under Spanish law.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain, with jurisdiction in the courts of Madrid. Consumers within the European Union may have additional rights under local consumer protection laws.
